The legal challenge, filed Friday, claims Miller forfeited her seat on March 24 when she approved a personnel report that included her relative, an act the state constitution strictly prohibits for public officials. While Miller has requested to rescind her vote to avoid the appearance of a conflict of interest, the lawsuit asks the court to declare her office vacant and nullify any board actions she has participated in since the incident.
